Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur;
Day: calendar day;
Ongoing contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of an organized system for distance selling, whereby exclusive use is made of one or more means of distance communication;
Means of distance communication: a method that can be used to conclude a contract without consumer and entrepreneur being in the same place at the same time;
General Terms and Conditions: these General Terms and Conditions of the entrepreneur.


Article 2 – Applicability

These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer.

Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the terms can be consulted and that they will be sent free of charge upon request.

If the distance contract is concluded electronically, these terms may be made available electronically in such a way that they can be easily stored on a durable data carrier.

If specific product or service conditions apply in addition to these General Terms and Conditions, the consumer may always rely on the provision that is most favorable to them in the event of a conflict.

If any provision of these terms is null or void, the remaining provisions will remain in full force. The invalid provision will be replaced by a provision that most closely reflects the original intent.

Situations not covered by these terms shall be assessed in accordance with the spirit of these General Terms and Conditions.


Article 3 – The Offer

If an offer has a limited validity or is subject to conditions, this will be explicitly stated.

All offers are non-binding. Lumora-boutique reserves the right to modify or withdraw offers.

The offer includes a complete and accurate description of the products and/or services. Images are indicative; no rights can be derived from them. Obvious errors or mistakes do not bind the entrepreneur.

Displayed colors may differ from actual product colors.

Each offer clearly states:

  • the price (excluding import VAT and customs clearance costs);

  • shipping costs;

  • how the contract is concluded;

  • whether the right of withdrawal applies;

  • payment, delivery, and execution methods;

  • the validity period of the offer;

  • available sizes, colors, and materials where applicable.


Article 4 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

Upon electronic acceptance, Lumora-boutique will immediately confirm receipt electronically. Until confirmation is sent, the consumer may cancel the contract.

Lumora-boutique takes appropriate technical and organizational measures to protect electronic data transfers and online payments.

All contracts are subject to product availability.


Article 5 – Right of Withdrawal

Consumers have the right to withdraw from the purchase within 30 days of receiving the product, without giving any reason.

During this period, the consumer must handle the product and packaging with care. Products should be returned in original condition and packaging where reasonably possible.

The consumer must notify Lumora-boutique of the withdrawal in writing or by email within 30 days of receipt. The product must then be returned within 30 days after notification.

If these conditions are not met, the purchase becomes final.


Article 6 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

Refunds will be issued within 30 days after receipt of the returned product or proof of return shipment.


Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • made to consumer specifications;

  • clearly personalized;

  • that cannot be returned due to their nature;

  • that deteriorate quickly;

  • whose price depends on financial market fluctuations;

  • sealed hygiene products once opened;

  • sealed audio/video/software products once unsealed.


Article 8 – Prices

Prices will not be increased during the stated validity period, except due to VAT changes.

All prices are subject to typographical errors.

Products are shipped from outside the EU; import VAT and customs fees may be charged to the recipient.

Article 10 – Conformity & Warranty

Products comply with the agreement, specifications, and applicable laws.

Any defects must be reported within 30 days of delivery.

Warranty corresponds to the manufacturer’s warranty and does not affect statutory consumer rights.


Article 11 – Delivery & Execution

Orders are processed with due care and delivered to the address provided by the consumer.

Delivery occurs within 30 days unless otherwise agreed.

Risk of loss or damage transfers to the consumer upon delivery.


Article 12 – Ongoing Contracts

Consumers may cancel ongoing contracts at any time with a maximum notice period of one month.

Fixed-term contracts cannot be automatically renewed unless legally permitted.


Article 13 – Payment

Payments must be completed within 7 working days unless agreed otherwise.

Incorrect payment details must be reported immediately.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days of discovery.

Complaints are answered within 30 days.


Article 15 – Disputes

All agreements are governed exclusively by Dutch law.


Article 16 – CESOP

Payment service providers may register transaction data in the European CESOP system in accordance with EU regulations effective from 2024.
